Can a No Fault Divorce Be Filed in Nevada?

Nevada is exclusively a no-fault divorce state, which means that it does not make divorce decrees based on the fault of either spouse. Instead, a couple can file for divorce using one of the following reasons:

  • Incompatibility – If one spouse can demonstrate that the couple is no longer compatible and that there’s no reasonable chance that this will change, then this is a ground for divorce.
  • Separate living – If a couple can’t demonstrate that they are incompatible, then they can get a divorce if they have lived in separate residences for at least one year.
  • Legally insane – While this reason is less common, it is possible for one spouse to file for divorce if the other spouse has been deemed legally insane for at least two years.
